Terms of Service

 These Terms of Service ("Terms") govern your use of the services provided by ModernHost.co ("we," "us," or "our"),  including web hosting, domain registration, and related services. By purchasing or using our services, you agree to   these Terms in full.

 ---  1. Acceptance of Terms

 By creating an account or using any ModernHost.co service, you confirm that you are at least 18 years of age, have  read and understood these Terms, and agree to be bound by them. If you do not agree, do not use our services.

 ---  2. Services

 ModernHost.co provides web hosting and domain registration services. We reserve the right to modify, suspend, or  discontinue any service at any time with reasonable notice where possible.

 ---  3. Account Responsibilities

 You are responsible for:  - Maintaining the confidentiality of your account credentials  - All activity that occurs under your account  - Providing accurate and up-to-date billing and contact information  - Notifying us immediately at bryan@modernhost.co of any unauthorized account access

 ---  4. Acceptable Use Policy

 You agree not to use our services to:  - Host, transmit, or distribute illegal content of any kind  - Send unsolicited bulk email (spam)  - Distribute malware, viruses, or other malicious code  - Conduct phishing, fraud, or other deceptive activities  - Infringe upon any third party's intellectual property rights  - Engage in activities that excessively consume server resources in a way that degrades performance for other  customers  - Violate any applicable local, state, federal, or international law

 We reserve the right to suspend or terminate accounts found in violation of this policy without refund.

 ---  5. Domain Registration

 - Domain registrations are subject to the terms and policies of the applicable registry and ICANN.  - You are responsible for providing accurate WHOIS information. Providing false information may result in domain  suspension or cancellation.  - Domain registrations are non-refundable once the registration has been submitted to the registry.  - We are not liable for the loss of a domain due to failure to renew on time. It is your responsibility to ensure  renewals are processed before expiration.

 ---  6. Hosting Services

 - Hosting accounts are provisioned on shared, VPS, or dedicated infrastructure as specified in your plan.  - You are solely responsible for all content stored on or transmitted through your hosting account.  - We perform routine backups as a courtesy but do not guarantee backup availability. You are responsible for  maintaining your own backups of all data.  - Resource limits apply as described in your hosting plan. Accounts found to be consistently exceeding limits may  be required to upgrade or may be suspended.

 ---  7. Payment and Billing

 - All fees are due in advance as stated at the time of purchase.  - Recurring services will be automatically billed at the end of each billing cycle unless cancelled.  - Failure to pay may result in service suspension. Accounts suspended for non-payment for more than 14 days may be  terminated and data permanently deleted.  - All fees are listed in USD. You are responsible for any applicable taxes.  - We reserve the right to change pricing with at least 30 days' notice.

 ---  8. Refund Policy

 - Hosting services may be eligible for a refund within 30 days of the initial purchase if you are not satisfied.  Renewals are non-refundable.  - Domain registrations and renewals are non-refundable.  - Accounts terminated for violation of these Terms are not eligible for refunds.

 ---  9. Suspension and Termination

 We reserve the right to suspend or terminate your account at any time for:  - Violation of these Terms or our Acceptable Use Policy  - Non-payment  - Fraudulent activity  - Any activity that poses a risk to our infrastructure or other customers

 You may cancel your account at any time by contacting us at bryan@modernhost.co. Cancellation does not entitle you  to a refund except as described in Section 8.

 ---  10. Limitation of Liability

 To the maximum extent permitted by applicable law, ModernHost.co shall not be liable for any indirect, incidental,  special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or service   interruptions, even if we have been advised of the possibility of such damages.

 Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed  the amount you paid to us in the three (3) months preceding the claim.

 ---  11. Disclaimer of Warranties

 Our services are provided "as is" and "as available" without warranties of any kind, either express or implied,  including but not limited to implied warranties of merchantability, fitness for a particular purpose, or  non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or  other harmful components.

 ---  12. Indemnification

 You agree to indemnify, defend, and hold harmless ModernHost.co and its officers, employees, and agents from any  claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our services,  your content, or your violation of these Terms.

 ---  13. Privacy

 Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by  reference. We will not sell your personal information to third parties.

 ---  14. Governing Law and Dispute Resolution

 These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions.  Any disputes arising under these Terms shall be resolved in the state or federal courts located in Seattle,  Washington, and you consent to personal jurisdiction in those courts.

 ---  15. Changes to These Terms

 We reserve the right to update these Terms at any time. We will notify you of material changes via email or a  notice on our website at least 14 days before the changes take effect. Continued use of our services after that  date constitutes acceptance of the updated Terms.
